Terms Of Service

We guarantee to add $30,000–$250,000 in monthly revenue to your eCommerce store within 60 days—or you don’t pay.

To qualify for this performance guarantee, your store must meet the following minimum criteria: At least 30,000 monthly store sessions, and At least 10,000 email subscribers. If your store does not meet these requirements, Killens Media will instead offer a custom performance guarantee, tailored to your business’s current metrics and growth potential.

If no uplift is seen and our recommendations are implemented in good faith, you’re entitled to a full refund.

2. Ownership & Licenses

‍Client Ownership: All completed work (email designs, flows, templates, copy, etc.) is fully owned by the client upon final payment.

‍Agency Usage: We may showcase completed work in our portfolio, website, or case studies, unless requested otherwise in writing.

‍Use of Client Assets: You grant us a limited, revocable license to use your brand assets solely to perform our services.

3. Independent Contractor StatusKillens Media operates as an independent contractor. We are not employees or legal partners of your business and are responsible for our own tools, taxes, and obligations.

4. ConfidentialityWe respect and protect your private information:Any sensitive data shared with us is kept confidential.Upon termination, we will delete or return all confidential materials.Exceptions apply only if the information is publicly known, independently developed, or lawfully obtained.

5. Termination PolicyEither party may end this agreement with 14 days written notice.If the agreement is terminated within 14 days of signing, the client will receive a full refund.You remain responsible for any completed work and non-refundable expenses up to the termination date.

6. Non-SolicitationDuring the engagement and for 12 months after termination:We won’t recruit your staff, vendors, or clients.We won’t interfere with your client relationships.

7. Legal and ComplianceWe guarantee that all work produced is original and does not infringe on any third-party rights.You confirm that any materials you provide us (logos, images, etc.) are legally yours to use.

8. Liability LimitationsNeither party is liable for indirect or consequential damages. Liability is limited to the value of the contract unless caused by breach of agreement or negligence.

9. IndemnificationEach party agrees to protect the other from losses arising from:Breach of agreement.Use of infringing materials.Violation of applicable laws.
